The California Vehicle Code requires that: a driver of a vehicle intending to turn left or make a U-turn on a highway, or to turn left into public or private property shall yield the right of way to all vehicles coming from the opposite direction which are close enough to be a hazard at any time during the turning movement, and shall continue to yield the right of way until reasonable safe to make the movement.

To be convicted of violating California Vehicle Code Section 21801(a), it must be proven that defendant:

  • Drove a motor vehicle;
  • Failed to yield to vehicles approaching from the opposite side when making a left or U-turn.

A conviction for a violation of Vehicle Code Section 21801(a) (Right-of-Way – Left Turn or U-turn) will result in the addition of 1 (one) point on a DMV driving record.

The fines for a violation of Vehicle Code Section 21801(a) (NOT including Penalty Assessments)  are:

  1. Fines of not more than $100 for the first infraction plus penalty assessments of 260%
  2. Fines of not more than $200 for the second infraction occurring within one (1) year of a prior infraction that resulted in a conviction
  3. Fines of not more than $250 for a third or subsequent infraction occurring within one (1) year of two or more prior infractions that resulting in convictions.
